Agreement to Terms

By accessing or using Vimsy's WordPress maintenance and support services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

Services Description

Vimsy provides WordPress maintenance, security, support, and development services. Our services include but are not limited to: WordPress core updates, plugin and theme updates, security monitoring, backup management, performance optimization, and technical support.

Service Plans and Billing

Subscription Plans

We offer various subscription plans (Press Lite, Press Pro, Press Elite) with different features and pricing. All prices are in USD and exclude applicable taxes unless otherwise stated.

Payment Terms

  • Monthly plans are billed monthly in advance
  • Annual plans are billed annually in advance
  • Payment is due immediately upon subscription
  • We accept major credit cards and other payment methods as displayed

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for the renewal amount.

Money-Back Guarantee

We offer a 30-day money-back guarantee on all new subscriptions. If you're not satisfied with our services within the first 30 days, contact us for a full refund. This guarantee applies only to first-time customers and does not apply to one-time services or custom development work.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellations will take effect at the end of the current billing period. We do not provide refunds for partial months or unused portions of annual plans, except as required by law or our money-back guarantee.

Client Responsibilities

You agree to:

  • Provide accurate and complete information when registering
  • Maintain the security of your account credentials
  • Provide necessary access to your WordPress site (hosting credentials, admin access)
  • Maintain regular backups of your site (in addition to our backup services)
  • Notify us promptly of any security issues or concerns
  • Use our services only for lawful purposes
  • Not interfere with or disrupt our services

Our Responsibilities

We will:

  • Provide the services described in your chosen plan
  • Maintain reasonable security measures to protect your data
  • Respond to support requests within the timeframes specified in your plan
  • Notify you of any significant issues affecting your site
  • Maintain regular backups as specified in your plan

Service Level and Uptime

While we strive to maintain 99.9% uptime for our monitoring and backup services, we cannot guarantee uninterrupted service. We are not responsible for downtime caused by factors outside our control, including but not limited to hosting provider issues, internet connectivity problems, or third-party service failures.

Limitation of Liability

To the maximum extent permitted by law, Vimsy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Backups and Data Recovery

While we maintain regular backups as part of our service, you are ultimately responsible for maintaining your own backups. We make reasonable efforts to restore sites from backups but cannot guarantee successful recovery in all circumstances. We are not liable for any data loss.

Third-Party Services

Our services may integrate with third-party services (hosting providers, CDNs, security services, etc.). We are not responsible for the availability, performance, or policies of these third-party services.

Intellectual Property

All content, features, and functionality of our website and services are owned by Vimsy and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of your website content and data.

Confidentiality

We will maintain the confidentiality of your login credentials, site data, and business information. We will not share this information with third parties except as necessary to provide our services or as required by law.

Termination

We reserve the right to suspend or terminate your access to our services immediately, without prior notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our services will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.
